Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of nbptpickleballclub.com (the "Site") and your membership in NBPT Pickleball Club (the "Club"), located near the entrance of the Newburyport Business and Industrial Park, Newburyport, MA 01950. By joining the waitlist, becoming a member, or using the Site, you agree to these Terms.

2. Eligibility

Membership is limited to individuals 18 years of age or older. You must provide accurate and current information when joining the waitlist or activating a membership.

3. Waitlist

Joining the founding member waitlist is free and does not require payment. A waitlist spot is a reservation only and does not guarantee a membership until you are contacted, you confirm activation, and your first payment is processed. You may remove yourself from the waitlist at any time by contacting us.

4. Membership & Billing

• Membership dues are $85 per month, billed in advance via the payment method on file.
• Billing begins on the date your membership is activated, after the Club opens and you confirm activation.
• Payments are processed by Stripe; by activating membership you also agree to Stripe's terms.
• Failed or declined payments may result in suspension of court access until the balance is resolved.
• We may change membership pricing with at least 30 days' written notice. Founding member pricing terms, if any, will be confirmed in writing at activation.

5. Cancellation & Refunds

• You may cancel your waitlist reservation at any time before the Club opens at no charge.
• Members may cancel membership at any time by emailing contact@nbptpickleballclub.com. Cancellation takes effect at the end of the current billing period.
• Monthly dues are non-refundable. We do not prorate partial months.

6. Member Cap & Waitlist Promotion

The Club is capped at 250 active memberships. If a member cancels, the next person on the waitlist will be invited to activate a membership. We reserve the right to adjust the cap only with notice to existing members.

7. Court Use & Booking

• Members get 24/7 access to the private indoor court via our online booking system.
• Booking limits are enforced to prevent any member from monopolizing the court. We may adjust limits to keep access fair.
• Members must follow posted court rules, scheduled cleaning windows, and any guest policies in effect.
• No-shows or repeated last-minute cancellations may result in temporary booking restrictions.

8. Conduct

Members and guests are expected to behave respectfully toward other members, staff, and the facility. We may suspend or terminate membership without refund for behavior that endangers others, damages the facility, violates the law, or materially disrupts other members' use of the Club.

9. Assumption of Risk & Liability Waiver

Pickleball is a physical activity that carries inherent risks, including but not limited to slips, falls, collisions, sprains, fractures, and other injuries. By becoming a member or entering the facility, you acknowledge and voluntarily assume these risks. To the fullest extent permitted by Massachusetts law, you release NBPT Pickleball Club, its owners, employees, and affiliates from any liability for injury, loss, or damage arising out of your use of the facility, except for injury or damage caused by our gross negligence or willful misconduct. A separate liability waiver may be required at activation.

10. Personal Property

We are not responsible for lost, stolen, or damaged personal property at the facility. Members use cubbies, lockers, and common areas at their own risk.

11. Intellectual Property

All content on the Site, including text, images, logos, and the NBPT Pickleball Club name, is owned by NBPT Pickleball Club or its licensors and may not be copied or used without permission.

12. Disclaimers

The Site and Club services are provided "as is" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by Massachusetts law, NBPT Pickleball Club's total liability to you for any claim arising out of these Terms or your membership shall not exceed the amount of membership dues you paid in the twelve (12) months preceding the claim.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Essex County, Massachusetts.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email to active members. Continued use of the Site or membership after changes take effect means you accept the updated Terms.
